Child Struck and Killed by Commercial Van in Northwest Houston

Earlier this week, a two-year old child was struck by an air conditioning repair company van.  The boy was riding his bike in the apartment complex when he was struck by the vehicle.  Police responded to the scene at Streamside Place Apartments.  The driver of the vehicle stayed at the scene of the accident and answered questions by the police.

 

The family of the child filed a lawsuit against Willowbrook Air Conditioning and Heating within a few days of the incident. The family did not sue the individual driver, only his employer.  An employer is vicariously responsible for the acts of its employees if the employees are acting within the course and scope of employment.
